Terms of Service

The rules and conditions that govern your use of MixCall

By downloading, installing, accessing, or using MixCall, you agree to be legally bound by these Terms of Service. If you do not agree to any part of these Terms, you must not use the App. These Terms form a binding legal agreement between you and MixCall Team.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and MixCall Team ("we," "us," or "our"), the operator of the MixCall mobile application ("App" or "MixCall").

By downloading, installing, registering for, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, Community Guidelines, and Child Safety Standards, all of which are incorporated herein by reference.

If you do not agree to these Terms, you are not authorised to use the App and must uninstall it immediately.


2. Eligibility — 18+ Only

MixCall is strictly intended for adults aged 18 years or older. By using the App, you represent and warrant that:

  • You are at least 18 years of age
  • You have the full legal capacity to enter into this binding agreement
  • You are not prohibited from using the App under the laws of your jurisdiction
  • You will comply with all applicable local, national, and international laws
🔞 Minors Are Strictly Prohibited

Accounts found to belong to individuals under 18 years of age will be permanently terminated without notice and all associated data will be deleted. We cooperate with authorities where minors are involved. See our Child Safety Standards for full details.


3. Description of Service

MixCall is a real-time video and text communication platform that provides the following services:

Random Matching Instant random pairing with other users based on gender, age, and country preferences
Text Chat Private text messaging and photo sharing between users
Profile Browsing Viewing public profiles including display name, age, country, and profile photo
Global Chat Rooms Age-based and country-based group interaction rooms
Premium Features Subscription-based features available through Google Play

MixCall Team does not guarantee continuous, uninterrupted, or error-free service and may modify or discontinue any feature at any time without prior notice.


4. User Accounts

MixCall operates a guest-based account system. No email address, phone number, or social media login is required. During onboarding, users provide:

  • A display name (optional)
  • Date of birth (required for age verification)
  • Gender selection (required for matching)
  • An optional profile photo

You are solely responsible for all activity that occurs through your account and for maintaining the security of your device. Because MixCall uses a guest-based system with no linked credentials, deleted accounts cannot be recovered.

You may delete your account at any time via the in-App Settings. See our Account Deletion Guide for step-by-step instructions.


5. User Conduct & Prohibited Activities

By using MixCall, you agree to comply with our Community Guidelines. You agree not to engage in any of the following prohibited activities:

🚫 Explicit content — Share nudity, sexually explicit material, or engage in sexual acts during video calls
🚫 Minor exploitation — Share, solicit, or produce any content involving minors in a sexual context
🚫 Harassment & threats — Harass, threaten, intimidate, stalk, or abuse other users
🚫 Hate speech — Post or broadcast racist, sexist, homophobic, or discriminatory content
🚫 Escort & adult services — Solicit, advertise, or offer prostitution or escort services
🚫 Impersonation — Impersonate any individual, organisation, or MixCall staff
🚫 Illegal content — Share, distribute, or promote illegal material of any kind
🚫 Hacking & fraud — Attempt to hack, exploit, or circumvent any App security mechanism
🚫 Spam & advertising — Send unsolicited commercial messages, chain letters, or spam
🚫 Ban evasion — Create new accounts to circumvent a suspension or permanent ban
🚫 Malware & bots — Introduce viruses, bots, scrapers, or automated systems into the App
🚫 Recording without consent — Record, screenshot, or capture other users' video or audio without their explicit consent

Violation of these rules may result in immediate suspension, permanent account termination, and referral to law enforcement where appropriate.


6. User-Generated Content

You are solely responsible for all content you create, upload, transmit, or display through MixCall, including text messages, uploaded images, profile photos, and live video behaviour.

6.1 Your Responsibilities

  • You represent that you own or have the necessary rights to all content you share
  • You warrant that your content does not violate any third-party intellectual property, privacy, or legal rights
  • You accept full legal liability for any content you share in violation of applicable law

6.2 Our Rights

By submitting content to MixCall, you grant MixCall Team a non-exclusive, royalty-free, worldwide licence to use, store, display, and transmit your content solely for the purpose of operating the App and providing the Service. We do not claim ownership of your content.

We reserve the right — but not the obligation — to:

  • Monitor, review, or remove any content at our sole discretion
  • Restrict or permanently ban accounts posting violating content
  • Report unlawful content or conduct to relevant authorities
  • Cooperate fully with law enforcement investigations

7. Zero Tolerance Policy

MixCall Team maintains an absolute zero-tolerance policy for the following conduct. There are no warnings — violation results in immediate permanent termination and mandatory reporting to authorities.

Sexual exploitation of minors
Grooming or soliciting minors
Non-consensual intimate imagery
Prostitution or escort solicitation
Human trafficking facilitation
Incitement to terrorism or violence
Distribution of malware or exploit tools

We cooperate fully with law enforcement authorities, including the National Center for Missing & Exploited Children (NCMEC) and relevant international agencies. All CSAM-related incidents are reported without exception.

8. Privacy

Your use of MixCall is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection, processing, and use of your data as described in the Privacy Policy.

Key privacy points include:

  • MixCall collects minimal data as we operate a guest-based system with no email or phone registration
  • We do not record video calls or retain audio streams
  • Your data rights (access, deletion, correction) are described in full in the Privacy Policy
  • Third-party SDKs (Firebase, Meta, TikTok, CAS.ai) are used for analytics and advertising — see the Privacy Policy for full SDK disclosures

9. Subscriptions & Payments

Certain premium features within MixCall may require payment through Google Play. All billing, invoicing, and payment processing is handled exclusively by Google Play and is subject to Google Play's Terms of Service ↗.

9.1 Subscription Terms

  • By purchasing a subscription, you authorise recurring charges to your Google Play payment method
  • Subscriptions automatically renew at the end of each billing period unless cancelled
  • You must cancel your subscription through your Google Play account before the renewal date to avoid future charges
  • Deleting your MixCall account does NOT automatically cancel your Google Play subscription
⚠️ How to Cancel Your Subscription

Go to Google Play Store → Subscriptions → MixCall → Cancel. MixCall Team is not responsible for charges incurred due to failure to cancel through Google Play. See our Account Deletion Guide for more information.

9.2 Refunds

Refund requests are subject solely to Google Play's refund policy ↗. MixCall Team does not process refunds directly and has no ability to override Google Play's refund decisions.


10. Intellectual Property

All intellectual property rights in and to the MixCall App — including but not limited to the software, source code, algorithms, design, graphics, interface layouts, logos, trademarks, trade names, and all other branding elements — are owned by or licensed to MixCall Team.

10.1 Licence to You

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on your personal Android device solely for its intended purpose and in accordance with these Terms. This licence does not include any right to:

  • Copy, reproduce, distribute, or publish any part of the App
  • Modify, adapt, translate, or create derivative works
  • Reverse engineer, decompile, or disassemble the App's source code
  • Use the App for any commercial purpose without our express written permission
  • Remove, alter, or obscure any proprietary notices or labels

10.2 Feedback

If you submit feedback, suggestions, or ideas about MixCall, you grant MixCall Team a perpetual, royalty-free licence to use that feedback without any obligation to you.


11. Third-Party Services

MixCall integrates third-party services and may display advertisements from third-party ad networks. These third parties operate independently under their own terms and privacy policies.

MixCall Team is not responsible for the content, privacy practices, or actions of any third-party services. Your interactions with third-party services are governed solely by those third parties' own terms.


12. Reporting & Safety Features

MixCall provides in-App tools to help maintain a safe environment for all users:

  • Report — Report any user or content that violates these Terms or our Community Guidelines
  • Block — Block any user from contacting you or appearing in your matches
  • Skip — Immediately end a video call or text session at any time

We take all reports seriously. Reported accounts are reviewed by our moderation team. False or malicious reports may result in action against the reporting account.

To report child safety concerns, contact us at v4andro@gmail.com with the subject line "Child Safety Report". All such reports are actioned with highest priority. See our Child Safety Standards for more information.


13. Account Suspension & Termination

MixCall Team reserves the right, at its sole discretion, to:

  • Suspend an account temporarily pending investigation
  • Permanently terminate any account without prior notice
  • Remove, restrict, or modify any content at any time
  • Restrict access to all or part of the App

Enforcement actions may be taken for any violation of these Terms, our Community Guidelines, or applicable law. Grounds include — but are not limited to — zero-tolerance violations, repeated minor violations, fraudulent activity, and ban evasion.

Users who create new accounts to circumvent a ban or suspension will have those accounts permanently terminated. MixCall Team is not obligated to provide reasons for enforcement actions.


14. Disclaimer of Warranties

MixCall and all related services are provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied, including but not limited to:

  • Implied warranties of merchantability or fitness for a particular purpose
  • Guarantees of continuous, uninterrupted, or error-free availability
  • Guarantees of compatibility with all devices or operating system versions
  • Assurances that other users will comply with these Terms
  • Guarantees regarding the accuracy of user-provided information

You use the App entirely at your own risk. MixCall Team does not endorse or verify the identity, accuracy, or suitability of any user or user-generated content.


15. Limitation of Liability

To the maximum extent permitted by applicable law, MixCall Team, its directors, employees, agents, and licensors shall not be liable for:

  • Any user behaviour, user-generated content, or interactions between users
  • Any loss of data, revenue, profits, or business opportunities
  • Any indirect, incidental, consequential, punitive, or special damages
  • Any emotional distress, psychological harm, or personal injury arising from user interactions
  • Any service interruptions, technical failures, or security breaches beyond our reasonable control
  • Any harm arising from your reliance on content provided by other users

Where liability cannot be excluded by law, our total aggregate liability to you for all claims arising from or relating to the App shall not exceed the amount you paid us (if any) in the twelve (12) months preceding the claim.

You assume full responsibility for your interactions with other users. Always exercise caution when communicating with strangers online.


16. Indemnification

You agree to defend, indemnify, and hold harmless MixCall Team and its officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of or access to the App
  • Your violation of any provision of these Terms
  • Your violation of any applicable law, regulation, or third-party right
  • Your user-generated content, including any claim that it infringes a third party's rights
  • Any misrepresentation you make, including regarding your age or identity

17. Force Majeure

MixCall Team shall not be liable for any failure or delay in performing its obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, acts of God, pandemics, or epidemics
  • Government actions, laws, orders, or regulations
  • Failures of internet infrastructure, telecommunications providers, or cloud services
  • Cyberattacks, denial-of-service attacks, or other malicious third-party actions
  • Power outages or failures of critical technical infrastructure

We will use reasonable efforts to resume normal service as soon as practicable following a force majeure event.


18. International Use

MixCall is available globally. You are solely responsible for ensuring that your use of the App complies with the laws and regulations of your country or jurisdiction, including any restrictions on online communications, adult content platforms, or data transfers.

MixCall Team makes no representation that the App is appropriate or legally available in all jurisdictions. Access from territories where the App's content is prohibited is at the user's own risk and is the user's sole responsibility.

By using the App, you consent to the international transfer and processing of your data in accordance with our Privacy Policy.


19. Governing Law & Dispute Resolution

19.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to its conflict-of-law provisions. For users located in the European Union, United Kingdom, or other jurisdictions with mandatory consumer protection laws, those local laws apply to the extent they cannot be waived by contract.

19.2 Dispute Resolution

In the event of any dispute, claim, or controversy arising from or relating to these Terms or your use of MixCall ("Dispute"), the parties agree to first attempt to resolve the Dispute informally by contacting us at v4andro@gmail.com. We will endeavour to resolve the Dispute within 30 days.

If informal resolution fails, the Dispute shall be submitted to the exclusive jurisdiction of the competent courts located in Islamabad, Pakistan, except where mandatory local law requires otherwise.

19.3 No Class Actions

To the extent permitted by applicable law, you agree that any Dispute will be resolved on an individual basis only, and not as a plaintiff or class member in any purported class, collective, or representative action.


20. General Legal Provisions

20.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable. The remaining provisions of these Terms shall continue in full force and effect.

20.2 Waiver

No failure or delay by MixCall Team in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof. A waiver of any breach shall not be construed as a waiver of any subsequent breach.

20.3 Entire Agreement

These Terms, together with the Privacy Policy, Community Guidelines, and Child Safety Standards, constitute the entire agreement between you and MixCall Team regarding your use of MixCall and supersede all prior agreements, representations, and understandings.

20.4 Assignment

You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction, including in connection with a merger, acquisition, or sale of assets.

20.5 No Partnership

Nothing in these Terms shall be construed to create a partnership, joint venture, employment, franchise, or agency relationship between you and MixCall Team.


21. Changes to These Terms

We reserve the right to modify these Terms at any time. When material changes are made, we will:

  • Update the "Effective Date" at the top of this document
  • Notify users through an in-App notification or prominent banner
  • Where required by law, seek renewed consent

Your continued use of MixCall after the updated Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue using the App.
