1. Acceptance of Terms

By downloading, installing, accessing, or using MixCall ("the App"), you agree to be legally bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not use the App.

2. Eligibility – Adults Only (18+)

MixCall is strictly intended for users who are at least 18 years old. By using the App, you confirm that:

  • You are 18 years of age or older.
  • You have the legal capacity to enter into this agreement.
  • You will comply with all applicable laws.

Accounts found to belong to individuals under 18 will be permanently terminated without notice.

3. Description of Service

MixCall provides:

  • Real-time video communication
  • One-to-one text chat
  • Profile browsing
  • User-generated content sharing
  • Subscription-based premium features

MixCall does not guarantee continuous, uninterrupted, or error-free service.

4. User Accounts

MixCall operates using a guest-based account system. Users may provide:

  • Display name
  • Date of birth
  • Gender
  • Optional profile photo

You are solely responsible for maintaining the confidentiality and proper use of your device and account. Because MixCall does not use email or phone registration, deleted accounts cannot be recovered.

5. User Conduct and Prohibited Activities

You agree NOT to:

  • Share nudity or sexually explicit content
  • Engage in sexual acts during video calls
  • Solicit escort or adult services
  • Share content involving minors
  • Harass, threaten, or abuse other users
  • Use hate speech or discriminatory language
  • Impersonate another individual
  • Share illegal content
  • Attempt hacking, fraud, or security breaches
  • Send spam or unauthorized advertisements
  • Circumvent bans or enforcement actions

Violation of these rules may result in immediate suspension or permanent account termination.

6. User-Generated Content

Users are solely responsible for all content they share, including:

  • Text messages
  • Uploaded images
  • Profile photos
  • Live video behavior

MixCall does not pre-screen all content but reserves the right to:

  • Remove content
  • Restrict accounts
  • Permanently ban users
  • Report unlawful conduct to authorities

7. Zero Tolerance Policy

MixCall maintains a zero-tolerance policy for:

  • Sexual exploitation
  • Child abuse material
  • Prostitution or escort solicitation
  • Non-consensual conduct
  • Violent or illegal activities

We reserve the right to cooperate with law enforcement authorities where required.

8. Privacy

Your use of MixCall is also governed by our Privacy Policy. By using the App, you consent to data collection and processing as described in the Privacy Policy.

9. Subscriptions and Payments

Certain features may require payment through Google Play. All billing is handled by Google Play.

By purchasing a subscription:

  • You authorize recurring charges (if applicable).
  • Subscriptions automatically renew unless canceled.
  • You must cancel subscriptions through your Google Play account.

Deleting your MixCall account does NOT cancel an active subscription. Refunds are subject to Google Play policies.

10. Intellectual Property

All content, branding, logos, software, and design elements of MixCall are owned by or licensed to MixCall Team. You may not copy, reproduce, modify, distribute, or reverse engineer any part of the App without written permission.

11. Account Suspension and Termination

MixCall reserves the right to:

  • Suspend accounts
  • Permanently ban users
  • Remove content
  • Restrict access

We may take enforcement action at our sole discretion without prior notice. Users who attempt to bypass a ban may be permanently restricted from accessing the platform.

12. Disclaimer of Warranties

MixCall is provided on an "as-is" and "as-available" basis. We do not guarantee:

  • Continuous availability
  • Error-free performance
  • Compatibility with all devices
  • That other users will comply with these Terms

You use the App at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law, MixCall Team shall not be liable for:

  • User behavior
  • User-generated content
  • Loss of data
  • Indirect or consequential damages
  • Emotional distress arising from user interactions

Users assume full responsibility for their interactions with others.

14. Indemnification

You agree to indemnify and hold harmless MixCall Team from any claims, damages, liabilities, or legal expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any law
  • Your infringement of third-party rights

15. International Use

Users are responsible for compliance with local laws. MixCall may operate servers in various jurisdictions. By using the App, you consent to international data processing.

16. Changes to Terms

We may modify these Terms at any time. Updated Terms become effective when posted within the App or on our official page. Continued use of the App constitutes acceptance of revised Terms.

17. Governing Law

These Terms shall be governed by and interpreted in accordance with applicable laws, without regard to conflict-of-law principles. Any disputes arising from these Terms shall be resolved in accordance with applicable legal procedures.
